Terms of sale
These terms apply to purchases in the Vitoma web shop. The Norwegian version governs if there is any difference.
1. Seller
The seller is Vitoma AS, [Organisation number missing]. Address: Sørflåtveien 59, 4018 Stavanger. Email: post@vitoma.no. Phone: +47 463 89 828. Opening hours: 09–21.
2. The contract
The contract is made when you complete the order and receive an order confirmation by email. We store the order. You can find it under My account or through the link in the confirmation. The terms apply to consumers and business customers, with the differences described below.
3. Goods and prices
Prices are in Norwegian kroner. For private customers the price includes VAT (25%). Business customers can choose to see prices excluding VAT. Delivery is added and shown at checkout before you pay. The total price with all costs is in the summary before you confirm.
Prices are only shown for goods in stock. If an item is out of stock you can send an inquiry and we reply with a price and delivery time. We reserve the right to correct obvious errors in price or stock.
4. Payment
You can pay with Vipps or card, and by bank transfer. Approved business customers can choose invoice. The order is binding on you when you press "Place order with obligation to pay". For online payment the goods are reserved for 15 minutes while you pay. If payment is not completed the goods are released.
For bank transfer we send the account number and payment reference once the order is processed, and the goods are reserved until we see the payment. Invoice customers get an invoice with the due date stated on it.
5. Delivery and collection
We only deliver to postcodes in Rogaland that are in our delivery area. The delivery price depends on zone and weight and is shown at checkout. If the order is too heavy, has items too long for standard delivery, or we do not deliver to the postcode, you can send a delivery inquiry and we give you a price and delivery time. Collection from our warehouse is free. We tell you when the goods are ready.
The delivery time is agreed when ordering or stated in the order confirmation. Unless otherwise agreed we deliver within 30 days of your order. Risk passes to you when you or someone you appoint has received the goods. Check the goods on receipt and tell the driver or us if anything is damaged.
6. Right of withdrawal
Consumers have a 14-day right of withdrawal under the Norwegian Right of Withdrawal Act. See the Withdrawal page for the rules, exceptions and the withdrawal form. Business customers have no right of withdrawal under that act.
7. Complaints and defects
For consumers the Consumer Purchase Act applies. The complaint period is 2 years, and 5 years for parts meant to last considerably longer. You must notify us within a reasonable time after you discovered the defect. A notice within two months of discovery is always in time. For business customers the Sale of Goods Act applies, and you must complain within a reasonable time after you discovered or should have discovered the defect.
Send complaints to post@vitoma.no with the order number and a description, preferably with photos. You can demand repair, replacement, a price reduction or cancellation under the law.
8. Delay and force majeure
If delivery is delayed you can, under the law, demand performance, cancel the purchase or claim damages. We are not liable for delay or non-delivery caused by events outside our control, such as strikes, bad weather, fire, public orders or failure by suppliers and carriers. We tell you as soon as we can.
9. Business customers and invoice
Invoice purchases require that we have approved the business. We check the organisation number against the Norwegian Business Register. The due date is on the invoice. For late payment we may charge reminder fees and interest under the Late Payment Interest Act. We may at any time require advance payment.
10. Privacy
We process your personal data as described in the privacy policy.
11. Complaints and disputes
Contact us first at post@vitoma.no and we will try to solve the matter. Consumers can bring the case to the Norwegian Consumer Disputes Tribunal (forbrukerklageutvalget.no) if we do not agree. Guidance is available from the Norwegian Consumer Authority (forbrukertilsynet.no).
The contract is governed by Norwegian law. Disputes are decided by Norwegian courts. For consumers the mandatory venue rules apply.
